Transfers

Firearms Sales and Transfers are processed by local FFL holders in order to comply with Federal, State and Local Laws. The process is usually simple and uneventful. The following is the basic process of a sale or transferring a firearm.

Sales

When a local buyer wishes to purchase a firearm the local buyer will negotiate the transaction with local dealer at his place of business. If the local buyer is purchasing a long gun then a driver’s license will need to be presented and ATF Form 4473 will be filled out by the local buyer. If the purchase is a handgun then the local buyer will need to present a valid State Pistol Permit, a Pistol Purchase Coupon and a Driver’s License. If the local buyer is exempt from a pistol permit (Law Enforcement, Government, Federal etc.) then their credentials and a driver’s license would need to be provided.

The local dealer will perform a NICS instant background check on ALL local buyers. Once the local dealer received a PROCEED from the NICS check and there are no limiting factors the local dealer will transfer the firearm to the local buyer. Out of state sales will be processed as transfers out to a receiving FFL dealer.

Transfer In

The local buyer contacts a local Firearms Dealer (FFL holder) and contracts with the dealer to have a firearm transferred. The local dealer provides his information (Copy of FFL) and perform a NICS instant background check on the local buyer prior to release of the firearm(s).

Once the local dealer received a PROCEED from the NICS check and there are no limiting factors the local dealer will transfer the firearm to the local buyer.

Transfer Out

The local seller contacts a local Firearms Dealer (FFL holder) and contracts with the local dealer to have a firearm transferred. The local dealer would require the receiving dealer's information (copy of FFL) and sends the firearm to the receiving dealer. All firearms being transferred out must go to an FFL. The receiving dealer contacts the receiving buyer and advises of the receipt of the firearm. The receiving buyer goes to the receiving dealer's place of business with positive ID to pick up the firearm.

The receiving dealer will have the receiving buyer fill out an ATF Form 4473 and perform a NICS instant background check on the receiving buyer prior to release of the firearm(s). Once the receiving dealer received a PROCEED from the NICS check and there are no limiting factors the receiving dealer will transfer the firearm to the receiving buyer.

ALL FIREARMS RECEIVED FOR TRANSFER MUST COMPLY WITH ALL LOCAL, STATE AND FEDERAL LAWS. ANY FIREARM WHICH WOULD BE CONSIDERED ILLEGAL (UNLESS THE RECEIVER FALLS UNDER ONE OF THE NYS EXEMPTION CATEGORIES) WILL BE EITHER MADE LEGAL (IF POSSIBLE) PRIOR TO TRANSFER OR BE SHIPPED BACK TO THE SENDER.
